Season 1, Episode 5: Brand Protection 101: Trademark Law

If I had a dollar for every time that I saw trademarking being used by a brand in the fashion industry…. I would have that Bottega bag by now.

Trademark filing is entering dangerous territory. If used right, it can be one of the most powerful ways to protect a brand’s creation. Unfortunately, if used wrong it opens the door of vulunerability. In this episode we discuss trademark law in the fashion industry and how its used as a strategic tactic for brands to establish themselves (and in some cases, put their foot down).

One of the most iconic cases Yves Saint Laurent v. Christian Louboutin (2012) is discussed and shows the process of how a trademark case can get messy.
